■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ ┃ ┃ Multi Lingual Internet Mail Magazine ┃ ★ jp-Swiss-journal - Vol. 146 - September 21, 2013 (Swiss Time) ┃ ☆ http://www.swissjapanwatcher.ch/ ┃ ■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ 【 目次 / INDEX / INHALTSVERZEICHNIS 】 【J】 国民投票2013年9月22日： 1.「兵役義務廃止の国民発議」 2.「流行病修正法」 3. 「給油所営業時間緩和」 明子 ヒューリマン 【E】 The National Voting on September 22, 2013: 1. <Initiative to abolish compulsory military service>, 2. <Revision of the Epidemics Act> (Referendum vote) 3. <Liberalization of opening hours in petrol station shops> (Referendum vote) Akiko Huerlimann □━━━━━━━━━━━━【 日本語 】━━━━━━━━━━━━━━□ 国民投票2013年9月22日 *1)： 1.「兵役義務廃止の国民発議」 2.「流行病修正法」 3. 「給油所営業時間緩和」 明子 ヒューリマン 1. 「兵役義務廃止国民発議」は、軍隊は温存するが、男子の兵役義務は 廃止して、男女の志願兵で構成するという案だ。兵役の他にも民間防衛も 志願者で賄うという案。このGSoA *2) (グループ軍隊の無いスイス) の国 民発議が国民投票に漕ぎ着けたと言う事は、国民の一定の支持を集める事 が出来た訳だ。連邦政府と議会は議案に反対するよう推奨している。志願 制では安定的に人員を確保出来る保証が無く、国防に責任を持てない制度 になるというのが主な理由だ。 因みに、現行の兵役で定められている骨子を政府は以下の様に説明してい る。 - スイス男子は心身共に適格な場合、兵役義務に服する。 - 兵役適格者が兵役に服する事に良心の呵責を感じる場合は、社会奉仕の 任務に服する。これは兵役より期間が長い。 - 適格性が条件付きの場合、民間防衛の任務に就く。 - これ等の義務に従わない者には、徴兵交換課税が課される。 - 身体障害度が少なくとも40%の男子には、交換課税は課されない。 女性は兵役に志願出来る。この法律は連邦法の男女平等を侵害するもので はない。 元よりスイスの軍隊はあくまで中立を維持する防衛の為であり、他国を侵 略する意図が無い事は誰しも認めるところだ。戦乱は今の時代も世界各地 で起きていて、世界情勢は複雑さを増している。これまでのところ、過半 数の賛成票を得る見通しは無いと予想されている。万が一承認される事に でもなれば、スイスの中立も独立も確実に危うさを増すだろう。スイスに 対する周辺国や強国の圧力は強まる一方なのが現実だからだ。 2. 「流行病修正法」は政府と議会が成立させた法案で、当然政府・議会 は国民に賛成を求めている。2009年の豚インフルエンザと2003年のSARSが 流行した際に、関係当局がワクチンなどの手配に対応しきれなくなった経 験から、より綿密な手続きを定めて今後に備えようと出来た法律だ。40年 以上経っている旧法を時代に即した法律に改めた訳だ。旧法も新法も国が 定める予防接種を拒否する国民に強制はしていない。但し連邦政府とカン トンは医療現場等特定の職業人には摂取を強制出来るが、拒否する場合は 一時的に危険を及ばさないところに配置転換される。殆どの大政党と組織 は新法を支持しているが、保守党SVPと予防接種に批判的な人々、代替医 療や宗教活動家等の少数グループが同法に反対して国民投票に持ち込んだ のだが、法案は確定される形勢にあると伝えられている。 3. 「給油所営業時間緩和」は改正労働法で、当然政府・議会は賛成を求 めている。この法律に反対する「みどりの党」、SP（社会民主党）他少数 政党、労働組合、ルーテル教会、産業医、17のカントン等少なからぬ反対 勢力が法案に反対して国民投票に持ち込んだ。いわゆる24時間営業の給油 所の営業範囲を緩やかにする法案だ。連邦裁判所は午前1時から5時まで商 品にカバーをかけて販売してはいけないという判断を下している。だが梱 包された食品等は旅行者の利便性の為販売が許可されている。交通量の多 いアウトバーンとカントン・ツューリッヒの主要道路沿いの給油所おそよ 25か所で深夜の時間制限を解除する法改正が行われた。新旧両法案共給油 所の従業員が深夜勤務をする事に変わりは無い。食料品等扱う商品が増え れば従業員の作業量も増えるだろうが、こうしたスタンドの利益率は多く は無いと言われている。従って規制が緩和されたからと言って24時間営業 の給油所が急増するとは予想されていない。旅行者の利便性は増し、労働 者への影響も限定的であるようだ。 個人的な印象としては、今回の3議案はどれも敢えて国民投票で問う内容 ではない。だが、こうした少なくは無い無駄も、流血・捏造スキャンダル を防ぐ為の民主主義のコストと捉えるべきなのかもしれない。これまでの ところスイスは世界でまともに民主主義が機能している数少ない国と言え よう。誠に残念ながら、日本の民主主義は未だ未成熟な段階と言わざるを 得ない。少なくとも選挙民の半数程度は政治と経済を理解しようと努力し てはじめて機能するのが民主制度だからだ。スイスで実現されている民主 主義は、人類史上稀に見る公平で安定的に運用されている民主制度である が故、注意深く温存する必要がある。 【 参照 】 *1) 国民投票2013年9月22日： https://www.ch.ch/de/volksabstimmung-22-09-2013/ *2) Gruppe fuer eine Schweiz ohne Armee: http://de.wikipedia.org/wiki/Gruppe_f%C3%BCr_eine_Schweiz_ohne_Armee 【 編集後記 】 今回は長引く風邪で発行が遅くなってしまった。ラジオでも診療所でも風 邪が流行していると聞いた。早朝は寒く日中は暖かい寒暖の変化が激しい からだと言われている。読者諸兄も御身お大事に。 □━━━━━━━━━━━━【 English 】━━━━━━━━━━━━━━□ The National Voting on September 22, 2013 *1): 1. <Initiative to abolish compulsory military service> 2. <Revision of the Epidemics Act> (Referendum vote) 3. <Liberalization of opening hours in petrol station shops> (Referendum vote) Akiko Huerlimann 1. The <Initiative to abolish compulsory military service> <wants> to maintain the military service, but its aim is that the military should be formed by volunteers, men and women; the military obligation for men as listed in the constitution should however be abolished. Apart from the compulsory military service, the civil defense service should also be made voluntary. The initiative by <GSoA> (Gruppe Schweiz ohne Armee/Group Switzerland without Army) had reached the necessary number of signatures for such a national voting, which means that they have acquired a certain support among Swiss citizens. The Federal Government and the parliaments recommend the citizens to vote <No>. The main reason for that is that a volunteer system cannot ensure the personnel and cannot owe the responsibility for the national defense. By the way, the Federal Government explains the essential feature of the present rules as follows: - Swiss Men do military service if they are physically and mentally able. - Swiss Men who cannot agree with their conscience to carry out the military service, perform a civil community service which is longer. - Swiss Men who are conditionally fit, do service in civil defense. - Swiss Men who do not fulfill any of these obligations, have to pay military service exemption tax. - Swiss Men with a degree of disability of at least 40%, pay no replacement levy. Swiss Women may voluntarily perform the military service. That regulation does not violate the equal rights of men and women according to the Swiss Federal Court (Supreme Court). Principally, the Swiss Army is for defense purpose only to safeguard the Swiss Neutrality, and everyone admits that there is no intention to invade other countries. Even now armed conflicts break out in the world, the world situation is gaining complexity. So far the bill is expected to have no chance to get an affirmative vote by a majority. Should however, contrary to all predicts, such a vote be approved then the Swiss neutrality and independence would certainly be put in danger. Because the present reality is that pressure of powers and neighboring countries against Switzerland have become stronger in recent times. 2. <Revision of the Epidemics Act> was established by the Government and the parliaments, therefore, they recommend the citizens to vote <yes>. The revised law was introduced based on the experience of the swine flu epidemic in 2009 and of the SARS epidemic in 2003; the authorities are concerned and have turned out for support arrangements, such as vaccination, and becoming ready for the future by establishing a more thorough procedure. The old law dates back to 1970 and since then more than 40 years have passed; the Government changed the law in line with the age. The old law allowed it to make vaccination compulsory; in the new law however that possibility is strongly restricted. However, Cantons and the Federal Government can force compulsory vaccination to specific profession of medical practice; if someone however refuses such a measure, it can be temporarily relocated to another place where it doesn't to produce danger to the public. Many major political parties and organizations support the new law. However, the conservative party SVP, a small group of people who are critical of vaccination, alternative medicine circles, and religious activists are against the new law, putting the new law to a national voting by making a referendum. Anyway, reportedly the situation of the new law shall be determined (accepted). 3. <Liberalization of opening hours at petrol station shops> is the revised labor law, and of course the Government and the parliaments recommend to vote <Yes>. Considerable opposition came by groups such as the Green's, the SP-party, other minority political parties, trade unions, the Lutheran Church, industrial physicians, and 17 cantons, which opposed to the revised law and launched a referendum. The revised bill has the aim to deregulate the operating range at the so called 24 hours open shops at gasoline stations. The Federal Court has ruled that certain goods are not allowed to be sold at night from 1:00am to 5:00 am. However, packed foods are allowed to be sold for the convenience of travelers. The law was amended to remove the time limit at late-night regarding to about 25 sites (gasoline station shops) along heavy traffic main roads in the Canton of Zurich and at motorways. There will be no change for gasoline station employees; they work the graveyard shift both on the old and new bill. The amount of work for employees will increase, if foodstuffs has to be handled, however, it's said that profit margins at such stands are not much. Therefore even the regulation will be relaxed; the number of 24 hours open gasoline station shops isn't expected to increase rapidly. The convenience of travelers might increase, the impact on workers is likely to be limited. Based on my personal impression, the three bills of this time, the content of all three doesn't deserve a national voting. But, perhaps we should accept such a waste as a cost of the democracy in order to stop battle and fabricated scandals elsewhere. We can say that Switzerland is one of the few countries that has a properly functioning democracy in the world so far. It is really unfortunate that democracy in Japan is still at an immature level. If at least half of the constituency try to understand politics and economy, then democracy is the system that works properly.
