************************************************************** Multilingual Internet-Mail Magazine jp-Swiss-journal - Vol. 226 - December 21, 2024 (Swiss Time) https://www.swissjapanwatcher.ch/ ************************************************************************ 【 目次 / INDEX / INHALTSVERZEICHNIS 】 【J】 「駄々を捏ねると評された左派」と 2024年11月24日国民投票の結果 明子 ヒューリマン 【E】 "Leftists described as Spoiled" and The Results of the Popular Vote on November 24, 2024 Akiko Huerlimann 〜〜〜〜〜〜〜〜〜〜〜〜〜〜〜【 日本語 】〜〜〜〜〜〜〜〜〜〜〜〜〜〜〜 Part 1/2 「駄々を捏ねると評された左派」と 2024年11月24日国民投票の結果 明子 ヒューリマン 【 駄々を捏ねると評された左派 】 2024年12月12日、ローザンヌの連邦最高裁が、「女性の国民年金受給年齢引き 上げに関する国民投票を繰り返す必要はない」と、緑の党と社会民主党（SP） の女性政治家達に依る上告を棄却した。 女性側は、投票時にAHVの状況に関する誤った財務見通しが有権者に示された として、再投票を要求していた。 この公聴会には大きな関心が寄せられ、連邦最高裁判所の外には長い列ができ た。 https://www.tagesanzeiger.ch/frauenrentenalter-65-quengeleien-gehoeren-nicht-vor-gericht-226665535237 https://www.tagesanzeiger.ch/frauenrentenalter-65-gilt-bundesgericht-lehnt-beschwerden-zu-ahv-abstimmung-ab-917699773859 事の発端は、2022年09月25日の国民投票で、今後 10 年程度の国民年金（AHV） の財源確保を目指す改革について2議案が問われた。 1つ目は、「付加価値税の引き上げによるAHVの補完的資金調達」。 2つ目が、「老齢遺族年金制度改革」で、女性の国民年金受給年齢を64歳から 男性と同じ65歳に段階的に引き上げて、AHVの給付を調整する。 「付加価値税の引き上げ案」は、賛成55.07％で承認され、「女性の年金受給 年齢引上げ案」は、賛成50.55％という謂わば僅差で承認された、という背景 がある。（弊誌 Vol. 209 と Vol. 210 乞参照） https://swissjapanwatcher.ch/jp-Swiss-journal/jsj-vol209.htm https://swissjapanwatcher.ch/jp-Swiss-journal/jsj-vol210.htm ところが、2024年夏、連邦社会保険局がAHVの財政見通しの計算式に誤りがあっ た事を発表した。国民投票の際、2033年の支出は40億スイスフラン高めに予想 されていたが、その後、新たな計算で25億スイスフラン程度になった。 AHVは今後数年間、想定よりも良好な財政状態になるものの、赤字予想が修正さ れても、見通しは赤字のまま。この改革がなければAHVは更に赤字に転落すると いう事実に変わりはない。 この2つの提案は連動していた。政府配布の投票冊子には、「2つの案のうち1つ が否決されれば、改革全体が失敗に終わる」と記されていた。 連邦最高裁判所によれば、AHV21改革（AHV-女性の年金受給年齢）の投票だけを 取り消すことはできなかった。 しかし、女性の65歳定年制とは異なり、付加価値税の引き上げは既に年初から 施行されている。もし投票が無効にされれば、消費者は1年間、高い付加価値税 を支払うことになった。これは返済請求につながる可能性がある。 連邦最高裁判所の見解： 連邦当局が犯した誤りは、投票を繰り返すほど深刻なものではない。 連邦評議会は、投票前に十分な透明性のある情報を提供していた。 数値は予測であり、本質的に不確実性を伴うものである。 採決を取り消すことは法的確実性に反する。 但し、連邦最高裁判所が国民投票を覆した例は、これまでに1件ある。 2019年、結婚罰則に反対するCVPの国民発議に関する国民投票（僅差で「反対」 ）を無効とした。 この場合も、投票冊子に誤った数字が記載されていた。記載されていた8万組で はなく、45万4,000組が婚姻ペナルティの影響を受けたのだ。このとき裁判所 は、誤った情報が投票の自由を侵害したという結論に達した。裁判所は投票の やり直しを要求した。しかし、CVP（現中央党）は新たなイニシアチブを採用す ることを希望した。 【総論】 日頃左派寄りのメディアにさえ、「彼女たちが裁判所に上告したことは、流石 に無理があった。」と評された。 この国民投票結果を反故にする影響の大きさを考慮しない左派の女性議員達の 最重要課題は、自己アピールにしか見えない。 女性の国民年金受給年齢を1年引上げるだけの改革に、過剰に反応した。 今の高齢者は概ね元気だし、今後始まる年金生活で、生活資金が逼迫することの 方が重大事の筈だが、未だ若く実社会の経験が乏しい彼女達に、そういう事情を 考慮する気配が感じられないのは、社会の損失につながる。 Part 2/2 に続く 〜〜〜〜〜〜〜〜〜〜〜〜〜〜〜【 English 】〜〜〜〜〜〜〜〜〜〜〜〜〜〜 Part 1/2 Leftists described as Spoiled" and Results of the Popular Vote on November 24, 2024 Akiko Huerlimann [ Leftists described as "Spoiled" ] On December 12, 2024, the Swiss Federal Supreme Court in Lausanne rejected an Appeal by female Politicians from the Green Party and the Social Democrats (SP), regarding to the Vote on Raising the AHV-Pension Age for Women of Autumn 2022, making the Verdict that there was no Need to hold a second Referendum. The Women had demanded a second Vote, claiming that Voters had been shown incorrect financial Forecasts on the State of the AHV at the Time of the Vote. The first was a "Supplementary Financing of the AHV by Raising the Swiss Value-Added Tax (VAT)." The second was a "Reform of the Old-Age Survivors' Pension System (AHV)," which gradually raises the Age at which Women can receive the National Pension from the Year of 64 to 65, the same as Men, and by adjusting the AHV-Benefits. The Background to this is that the "Initiative to increase the Swiss Value-Added Tax (VAT)" was approved by 55.07% in favor (YES), and the "Initiative to raise the AHV-Pension Age for Women" was approved by a narrow Margin of 50.55% in favor (YES). At the Time of the Referendum's Vote, Expenditures in 2033 were predicted to be 4 Billion Swiss Francs higher, but after that, the new Calculations put it at about 2.5 Billion Swiss Francs. Although the AHV will be in a better financial Position than expected for the next few Years, even if the Deficit Forecast is revised, the Forecast remains in the Red. The Fact remains that without this Reform, the AHV will fall further into the Red. These two Initiatives were linked. The Voting-Booklet distributed by the Government stated that "if one of the two Initiatives is rejected, the entire Reform will fail." According to the Swiss Federal Supreme Court, it could not only cancel the Vote on the AHV21-Reform (AHV- Pension Age for Women) alone. However, unlike the mandatory AHV-Retirement Age for Women at 65, the Increase of Swiss-VAT has already been in effect since the Beginning of the Year 2024. If the Vote had been annulled, Consumers would have had paid a higher VAT for one Year. This could lead to Claims for Repayment. The Swiss Federal Supreme Court's Opinion: The Errors made by the Swiss Federal Authorities (Administration) are not serious enough to warrant Repeating the Vote. The Swiss Federal Council (Government) had provided sufficient and transparent Information before the Vote. The Figures are Forecasts and are inherently subject to Uncertainty. A Cancellation of the Referendum's Vote by a Court's Verdict would violate legal Certainty. However, there has been one Case so far where the Swiss Federal Supreme Court has overturned a Referendum's Vote. In 2019, it annulled the Referendum's Vote on the CVP's "Popular Initiative against the Marriage Penalty". (It was a rejected by a narrow Margin of "No-Votes"). In this Case too, the Government's Vote Booklet contained incorrect Figures. 454,000 Couples were affected by the Marriage Penalty instead of the 80,000 Couples listed in the Booklet. In this Case, the Swiss Federal Supreme Court concluded that the Misinformation violated the Freedom of the Vote. It demanded a Re-Vote. However, the CVP (now the Center-Party) wanted to adopt a new Initiative. Overview: Even the usually left-leaning Media commented that "the Appeal of the left-leaning Plaintiffs to the Swiss Federal Supreme Court was unreasonable." The left-leaning female Politicians, who do not consider the Magnitude of the Impact of Overturning the Referendum's Vote Results, only seem to prioritize Self-Promotion. They overreacted to a Reform that only raised the National (AHV)-Pension Age for Women by one Year.
