■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ ┃ Multi Lingual Internet Mail Magazine ┃ ★ jp-Swiss-journal - Vol. 163 - February 26, 2016 (Swiss Time) ┃ ☆ http://www.swissjapanwatcher.ch/ ■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ 【 目次 / INDEX / INHALTSVERZEICHNIS 】 【J】 国民投票2016年2月28日： 婚姻の不公平税制是正 外国人犯罪者の追放執行 食料品の投機的取引の禁止 第二のゴットハルト・トンネル建設 明子 ヒューリマン 【E】 The National Voting on February 28, 2016: Against marriage penalty, Enforce the deportation of criminal foreigners, No food speculation, Construction of a second Gotthard Tunnel Akiko Huerlimann □━━━━━━━━━━━━【 日本語 】━━━━━━━━━━━━━━□ 国民投票2016年2月28日： 明子 ヒューリマン 今年初めての国民投票 *1) は幾つかの議案で国論を二分する白熱した議論 が展開されている。主要政党の議案別の賛否一覧表 *2) と各政党の略称 *3)のリンク先を適宜参照されたい。 1. 国民発議「婚姻の不公平税制是正」/ Volksinitiative [Fuer Ehe und Familie - gegen die Heiratsstrafe]： 家族政策を重視するCVP(キリスト教民主党)が発議した議案だ。議案の要点 は同じ経済基盤の同棲カップルと比べると、婚姻夫婦には連邦税を多く支払 う不平等があり、年金生活の夫婦は国民年金(AHV)の上限受給額で不利益を 被っている、というもの。夫婦は一緒に課税されるべきで、婚姻は男性と女 性の共同体と規定されるべき；つまり法的形態に拘らないという考え方だ。 所得の規模に依って格差が変わるので、受け止め方は人それぞれのようだ。 連邦政府と議会は反対を推奨している。 2. 国民発議「外国人犯罪者の追放執行」 Volksinitiative [Zur Durchsetzung der Ausschaffung krimineller Auslaender (Durchsetzungsinitiative)] SVPが”Ausshaffungsinitiative”というスローガンで発議した「犯罪を犯 した外国人の居住権を自動的に剥奪して国外追放する憲法改正案」が2010年 11月28日の国民投票で承認された。(既報弊誌を参照されたい。) *4）*5) 連邦議会は憲法に外国人国外追放に相当する50以上の犯罪を列記して法制化 した。しかし官僚の裁量に委ねる余地を残した草案で、国民投票で信任され た議案は骨抜き同然になったと発議したSVPは理解した。左派の法務大臣と 連邦議会がEUとの交渉難航を危惧している事は広く知られている現実だ。ス イスの尊厳を第一義と考えるSVPはこの草案に満足せず、"Durchsetzungs-initiative" を発議した。絶対的追放を確保して公共の安全をより確かなも のにする為に、犯罪カタログを憲法に直接明記するよう求めた訳だ。議案に 反対しているのは、緑の党からFDPまでと、連邦政府、カントン、NGO、経済 団体。つまりSVPの孤独な闘いと言う状況だ。 ところが、反対派が最後の巻き返しキャンペーンとして、ツューリッヒ中央 駅に赤地に白でハーケンクロイツ(ナチスの象徴)が描かれた巨大ポスターを 発着掲示板の隣に掲示した。*6) スイス人と外国人二つの階級を生む司法制 度には反対という趣旨だ。しかし多数の抗議が寄せられた為、スイス鉄道 （SBB）は掲示を止めたと2月23日大きく報じられた。行き過ぎた表現と称さ れ、逆効果にもなり得る顛末になった。因みに諸外国の例では、凶悪犯罪者 は即刻国外退去させられている。 3. 国民発議「食料品の投機的取引の禁止」： Volksinitiative [Keine Spekulation mit Nahrungsmitteln!] 発議をしたのはJUSO（Young Socialist Party）社会民主党の青年部だが名 称は母党と同じではない。スイスの銀行、年金基金、その他の貿易・金融取 引等で、小麦、とうもろこし、砂糖、コーヒー豆等の食料品の投機取引を禁 じる議案。理由は食品投機が非倫理的である為。例外とされるのは農家、販 売業者、製粉業者。反対するのは保守政党や経済界、金融業界で、飢餓と闘 うには不適当な手段と一蹴した。実際問題商品先物取引市場はシカゴ等外国 にはあるが、スイス国内には無いので実効性が得られないと主張している。 連邦政府と議会は反対を推奨。 4. 「第二のゴットハルト・トンネル建設」山岳地域の道路交通に関する 連邦法修正案（ゴッタルド道路トンネルの修復/第二のトンネル建設）/ [Aenderung des Bundesgesetzes ueber den Strassentransitverkehr im Alpengebiet (Sanierung Gotthard-Strassentunnerl/Bau einer zweiten Gotthardroehre)]： 1980年に建設されたゴットハルト・トンネルの改修工事の間、通行を確保 する為に、第二のトンネル建設に向けて連邦法修正案を政府・議会が提出し た。改修工事終了後は二つのトンネルの利用を南下と北上に分け、上下線そ れぞれに予備車線が出来れば事故発生時にも対応出来る、と利点が挙げられ た。CVPのドリス・ロイトゥハルトゥ交通相が推進するこの議案を支持して いるのは、保守政党と経済団体、労働組合。推進キャンペーンでは運転者の 安全を強調し、工事中ティチーノの孤立を守れるとも主張している。しかし 乍ら、ティチーノの自治体の首長にも反対する声が少なくない。各種環境保 護団体はトンネルの拡張には、自動車道の渋滞を鉄道利用の促進で解消する 「山岳保護」の憲法に違反すると反対している。二つのトンネル合わせて4 車線になる自動車道は特に大型トラック(外国車両)の交通量の更なる増大を もたらすとも懸念されている。 この工事費は政府原案では28億スイスフラン（ざっと3,000億円相当）だが、 維持管理費は含まれていない。耐用年数を30年間と試算すると年平均100億 円程度にはなる。近隣諸国の道路改修費は遥かに少ないと言われており、そ うした国々はトンネル通行税を徴収して修繕費に充て、且通行管理もしてい る。スイスのトンネルでは通行管理をしていないので、過積載車両を監視す る為にも、これに倣うのが先決と思う。そもそもゴットハルト・トンネルの 渋滞よりも深刻な所は他にも多くあると報道されていたので、このトンネル だけに巨額の税金を注ぎ込む事に疑問が出るのは当然と言える。アルプスの 環境悪化を懸念する環境団体や左派系の政党が特に反対している。 調査会社[gfs.bern]がスイス公共放送[srg/ssr]の依頼で投票傾向を調査し た結果が発表された。「婚姻の不公平税制是正」の賛成は1回目の67％から2 回目はぐっと減って53％になり、反対21％から38％に増えた。しかし承認さ れる見通しは依然高いと予想されている。「外国人犯罪者の追放執行」の賛 成は1回目が51％から2回目には46％に減り、反対が42％から49％に増えた。 FDP親派の半数近くが議案に賛成という結果にSVPは歓迎していると報じられ たものの、2度目の調査で賛成が5％減少した。メディアの反対キャンペーン が目につく程で、発議側は地域で宣伝攻勢を強めている。「食料品の投機禁 止」の賛成は1回目が48％から2回目には31％へと減速し、反対が39％から54 ％へと増え、議案が承認される可能性は無いと報じられてしまった。基本的 な考え方は理解出来るものの、そもそもスイス国内には商品先物取引所が無 いので、スイス一国が導入しても効果は無いと言われ、議論の盛り上がりも 低調だ。「第二のゴットハルト・トンネル」の賛成は1回目の64％から2回目 は56％に減り、反対が29％から39％に増えた。外国のトラック交通量の急増 を特に心配するティチーノや仏語圏での反対が急速に増えていると報じられ ている。 この統計で分析された情報は次の通り。 1回目の世論調査（11.01.2016 - 15.01.2016） 回答者1,213人 *7) 2回目の世論調査 (05.02.2016 - 13.02.2016) 回答者1,411人 *8） 回答は千人強で、これ程僅かの人数の意見を調査機関が様々分析加工した結 果をメディアは一斉に報じた。国民の大多数の意見かと錯覚を起させる程だ が？報道に左右される有権者が多数存在する事を期待する報道機関の思惑が 見え隠れする。 *9) 予想に反する結果が出た場合は、驚きの結果と報じる のがメディアの常だ。之までスイスの報道は諸外国に比べて公平な報道をし ていると言う認識でいた。しかし一斉のキャンペーン報道の際は注意深く見 なければならないと思うようになって来た。誰もが何らかの利益追求集団に 属しているのだから鵜呑みにしてはならない。スイスには安易に人の意見に 同調しない「NEIN文化」が有ると言われているが、異なる意見を戦わせる心 構えを養う基盤と理解している。 【 参照 】 *1) 国民投票2016年2月28日Abstimmung vom 28. Please see proposals of the pros and cons list by major political parties, *2) and the party’s abbreviation *3) when necessary. 1. Popular initiative "Against marriage penalty"/ Volksinitiative [Fuer Ehe und Familie - gegen die Heiratsstrafe]: The bill was initiated by the CVP that focus on family policy. Families with a double-income pay unequally more federal taxes respectively pensioners are disadvantaged at the upper limit for entitlements of the national pension fund (AHV) compared with the same economic based cohabiting couples. Husband and wife should be taxed together, marriage should be defined as the community of men and women; that's the idea of the bill regardless of the legal form. The gap depends on the income size, therefore, perception seems to vary among individuals. The Federal Government and the Parliaments have recommended to vote "NEIN" (No). 2. Popular initiative "Enforce the deportation of criminal foreigners"/ Volksinitiative [Zur Durchsetzung der Ausschaffung krimineller Auslaender (Durchsetzungsinitiative)]: The SVP initiated a bill with the slogan of "Ausschaffungs- initiative", which is "the constitutional amendment for automatically depriving residency right and deporting foreign residents who committed crime"; that's been approved by the national voting on November 28, 2010. [See our previous issues of Vol. 122 *4) & Vol. 123 *5)] Then the Federal Parliaments legislated more than 50 crimes, which correspond to foreign exile in the constitution. However, the draft has left (much) room of discretion to the bureaucracy. The SVP as proponent understood that the public trust was watered-down by the bill. The left wing Minister of Justice and the Federal Parliaments are concerned about difficulties of negotiation with the EU that is well known as a fact. The SVP considers Swiss dignity is the first principle and does not satisfy with the draft, then initiated the so-called [Durchsetzungsinitiative] this time. In order to introduce measures of an absolute banishment to ensure public safety, the SVP claimed to have written a crime catalogue directly into the constitution. The opposition to the bill comes from the Green party up to the FDP, the Federal Government, the cantons, NGOs, and economic organizations. That is the situation; it may be said a lonely struggle of the SVP against all. However, as the last catch-up campaign, the opposition side displayed a huge poster with a Haken-Kreuz (Swastika) (considered as a Nazi-Symbol) in white on a red background next to the arrival and departure board inside Zurich's main Railway station hall. *6) The purport is against producing a judicial system of two class of Swiss and foreigners. However, on February 23 is widely reported that the Swiss Railway (SBB) received a large number of protests, then the poster was removed; the action was said to have exceeded limits, and in particular may also have a reverse effect. By the way, examples of other countries show that foreigners committing violent crimes will be punished severely and deported immediately from the (host) country. 3. Popular initiative "No food speculation"/ Volksinitiative [Keine Spekulation mit Nahrungsmitteln!] The bill is proposed by the JUSO（Young Socialist Party）. The bill intends to ban speculative trades with food products such as wheat, corn, sugar, coffee beans, and etc. at Swiss banks, pension funds, and at other trade and financial institutions. The reason is that food speculation is unethical. For farmers, distributors, miller's exceptions are made. Conservative parties, the business community, and the financial industry are against the bill; they scoff at the notion and say that the fight against hunger is inadequate. They argue that in practice, commodity future trading markets are in foreign country like Chicago, but not in Switzerland, therefore, the effectiveness cannot be obtained by such a bill. The Federal Government and the Parliaments recommend to vote "NEIN" (No). 4. Popular initiative "Construction of a second Gotthard road Tunnel"/ [Aenderung des Bundesgesetzes ueber den Strassentransitverkehr im Alpengebiet (Sanierung Gotthard-Strassentunnel/Bau einer zweiten Gotthardroehre)]: The Government and the Parliament submitted a federal law amendment, which proposed the construction of a second road tunnel during the renovation of the existing Gotthard road tunnel built in 1980, in order to ensure the passage. After the renovation is completed, two divided tunnel tubes can be used for the traffic; one is for the southbound and one is for the northbound traffic. The advantages are said to be in the safety, because each tunnel has a spare lane, which can be also used in the event of an accident. CVP politician and Minister of Traffic (UVEK) Mrs. Doris Leuthard promotes the bill, which is supported by conservative political parties, business organizations, and the labor union. The promotion campaign emphasized the safety of the drivers and appealed against the isolation of the Canton of Ticino during the construction period. However, not a few Mayors of main municipalities in the Ticino are against the bill. Various environmental groups are against the extension of the tunnel, which violates the Swiss constitution regarding to the article of the "mountain protection". It stipulates the elimination of congestions on the motorway by the promotion of the railway use for the transport of goods by trucks crossing the Alps (shift from road to rail). Altogether four-lanes in two motorway tunnels cause concerns about bringing a further increase of the traffic volume, especially large (foreign) trucks. The construction cost is 2.8 billion Swiss Francs according to the government draft (roughly 300 billion yen equivalent), but it does not include maintenance costs. Let’s say the expected lifetime is calculated by 30 years, then the annual average makes about 10 billion yen. Road repair costs of neighboring countries are said to be much less; those countries collect tunnel road tolls devoting them to the maintenance costs and make traffic control management. Switzerland doesn't control tunnel traffic yet, also regarding to the monitoring of overloaded vehicles, top priority is, to follow that system, I think. Anyway, as reported there are many other serious traffic jams more than at the Gotthard tunnel, therefore, a huge amount of tax pouring only to the tunnel is questioned. Environmental groups are concerned about the Alps environmental degradation and left-wing political parties are against the bill in particular. The research firm [gfs.bern] announced the result of the examination of voting trends by order of the Swiss public broadcasting station [srg/ssr]. In favor of the "unfair tax system correction for marriage couples" were 67% for the first time, and the second time, it was much less by 53%; opponents increased from 21% to 38%. Yet it's said that the approval prognostic is still positive. Proponents of the "Enforce the deportation of criminal foreigners" were 51% for the first time, and the second time, the figure dropped to 46%; the opponents increased from 42% the first time to 49% the second time. Although the SVP welcomed the report showing that nearly half of the FDP sympathizer were in favor of the bill, however, the second time, the study showed a reduction by 5%. The massive opposition campaign in the media become noticeable, and the initiative side strengthened the offensive campaign in the region. Proponents of the "No food speculation" have decelerated from 48% the first time to 31% the second time; opponents have increased from 39% the first time to 54% the second time. Reportedly the bill has no chance to be approved. It is said that the basic idea is understandable, but first there is no commodity future exchange market in Switzerland, therefore, introducing such a bill in Switzerland alone has no effect; the upsurge of discussion is also sluggish. Proponents of the "Construction of a second Gotthard road Tunnel" have decreased from 64% the first time to 56% the second time; opponents have increased from 29% to 39%. It is reported that the opposition side is growing rapidly, particularly in the region of Ticino and in the Swiss-French speaking part. There are concerns about a rapid increase of the traffic volume of (foreign) trucks. The analyzed information of these surveys is as follows: First round of survey (11.01.2016 - 15.01.2016); respondents 1,213 *7) Second round of survey (05.02.2016 - 13.02.2016); respondents 1,411 *8) The number of respondents were only about thousand and some more. The results of various processing analysis of such a small number of opinions by a research agency were reported in chorus by the media. Is that (really) enough to cause the illusion to understand the majority opinion of the people? We can glimpse an intention of the media that many voters are under the influence of their coverage. *9) If the result comes out contrary to the expectation, the media covers it by a story explaining it as a result of surprise. So far I can recognize that the Swiss media make a fair coverage compared to other countries. However, when the campaign news come in chorus, I think I have to be careful and reflect on it. Everyone belongs to some kind of profit group, I'd better not accept everything without questioning. Considering the urgent need of expenditure cuts of at the Federal budget, the Gotthard road tunnel plan is absurd.
