The US-Military called that in a statement a <collateral damage>. The derogatory US-statement triggered off worldwide disgust. The <MSF-Organization> spoke of a war crime and described the US-bomb attack as a <serious breach of international law>. The United Nations High Commissioner for Human Rights (UNHCHR) said it could be a war crime. The US-air attack on the civilian hospital lasted 30 minutes; all parties had been informed about the location of the hospital several times. The disgust is huge in the world; only in the USA hardly anyone is shocked. The US-Presidency candidates are quiet on their <Twitter-Accounts> about that tragedy. The Middle East expert Mr. Michael E. O'Hanlon, Co-Director of a US- Think tank, called it <a mockery> to describe the catastrophe as <collateral damage>. The US-Military changed its version of the US- bombs attack four times in four days; first the USA spoke of a <oversight>, later on the US-Military called it a <mistake>. The US- attack on the hospital was only one of many US-attacks that hit civilians, wrote a US-correspondent of the <Tages-Anzeiger>. The journalist meant that there was no <mistake in the (US)-System>; such a catastrophe had to be expected. There were already lots of them before and there will be many more to come, as long as US-troops are stationed in Afghanistan. According to the <Bureau of Investigative Journalism (TBIJ)> there were at least 1,670 drone missile strikes in the period of 2001 to 2013. According to the United Nations (UN), 1,700 civil persons were killed by air attacks since 2008; many incidents are well documented, others became public only thanks to <Wikileaks>. Das US-Militaer bezeichnete dies in einer Information als <Kollateral-Schaden> (collateral damage). Die abschaetzige US-Mitteilung loeste weltweit Empoerung aus. Die <MSF-Organisation> sprach von einem Kriegs- Verbrechen und beschrieb den US-Bomben-Angriff als <schweren Verstoss gegen humanitaeres Voelker-Recht>. Laut dem UNO-Hoch-Kommissariat fuer Menschen-Rechte koennte es sich um ein Kriegs-Verbrechen handeln. Der US-Luft-Angriff auf das zivile Krankenhaus dauerte 30 Minuten; alle Parteien waren mehrmals ueber den Standort des Spitals informiert worden. Die Empoerung auf der Welt ist riesig; nur in den USA empoert sich kaum jemand. Die US-Praesidentschafts-Kandidaten sind ruhig auf ihren <Twitter-Accounts> zu dieser Tragoedie. Der Nahost-Experte Michael E. O'Hanlon, Co-Director eines US-Think Tank, nannte es <einen Hohn>, das Unglueck als Kollateral-Schaden zu bezeichnen. One of them should therefore be elected as new Chair of the <Intergovernmental Panel on Climate Change(IPCC)>. The esteemed Swiss researcher works already for 17 years at the IPCC and is Co-Chair of the Work Group I; the US- American is Co-Chair of the Work Group II. Ahead of the election it was written that if the USA absolutely wanted that post then they could make enough pressure to get it. The previous Chair from India was elected in the year 2003 based on pressure by the USA and described as <weak figure> on that post. Now, surprisingly the economist Hoesung Lee from South Korea was elected as new Chair of the IPCC. The South Korean is called a <pale figure> (without charisma) and described as <not the Best person on that post>. <The nice man from South Korea>, as he is called in the headline of the Tages- Anzeiger, is said to have no own ideas and few visions about the future of the IPCC. The (boring) Korean gets no premature praise from the field of science. The South Korean intends to concentrate more on the economic climate research; his statements are however not concrete at all. With it the IPCC could get stronger into the <objective> of the politics. According to the Swiss candidate, South Korea had made an aggressive lobbying and the South Korean Government absolutely wanted that post for themselves. The objective of South Korea is to held more posts at international organizations in the future. The Swiss missed the second ballot by just only two votes. Ahead of the election, he had pointed out that the discussion about the climate change had become increasingly political and therefore strong scientific arguments are necessary! There were three candidates from Europe and that might have reduced the chance for the Swiss. Switzerland enjoys <World Reputation> in the field of climate research, therefore the Swiss ETH-Professor Andreas Fischling was elected as Vice-Chair of the Work Group II of the IPCC. Switzerland had intended to be candidate for one of the deputy posts of the IPCC Chair. The USA however absolutely wanted that post and therefore the Swiss withdrew its candidature. Nach wissenschaftlichen Kriterien sind der Schweizer Prof. Dr. Thomas Stocker von der Universitaet Bern und der US-Professor Christopher Field von der Stanford Universitaet die Besten in ihrem Fach. Einer der Beiden muesste also als neuer Vorsitzender (Chair) des Welt- Klimarats (IPCC) gewaehlt werden. Der angesehene Schweizer Forscher arbeitet bereits seit 17 Jahren fuer den IPPC und ist Co-Vorsitzender der Arbeits-Gruppe I; der US-Amerikaner ist Co-Vorsitzender der Arbeits-Gruppe II. Im Vorfeld der Wahl wurde geschrieben, dass die USA, wenn sie diesen Posten unbedingt wollten, genug Druck machen koennten um ihn zu erhalten. Der bisherige Vorsitzende aus Indien wurde im Jahr 2003 auf Druck der USA gewaehlt und als <schwache> Figur auf diesem Posten bezeichnet. Jetzt wurde ueberraschend der Oekonom Hoesung Lee aus Suedkorea als neuer Vorsitzender des IPPC gewaehlt. Der Suedkoreaner wird als <blasse Figur> und als <nicht der Beste Mann auf dem Posten> bezeichnet. <Der nette Mann aus Suedkorea>, wie ihn die Schlagzeile im Tages-Anzeiger nennt, haette keine eigenen Ideen und wenig Visionen fuer die Zukunft des IPCC. Aus dem Bereich der Wissenschaft bekommt der (farblose) Koreaner keine Vorschuss- Lorbeeren. Der Suedkoreaner moechte sich mehr auf die oekonomische Klima-Forschung konzentrieren; seine Aeusserungen sind jedoch gar nicht konkret. Damit koennte der IPCC staerker ins <Ziel> der Politik geraten. Laut dem Schweizer Kandidaten hat Suedkorea aggressiv Lobbying gemacht und die suedkoreanische Regierung wollte diesen Posten unbedingt fuer sich. Das Ziel von Suedkorea ist, in Zukunft mehr Positionen in internationalen Organisationen zu bekleiden. Der Schweizer verpasste den zweiten Wahlgang nur gerade um zwei Stimmen. Er hatte vor der Wahl darauf hingewiesen, dass die Diskussion um den Klima-Wandel immer politischer wuerde und deshalb starke wissenschaftliche Argumente noetig seien! Es gab drei Kandidaten aus Europa und dies hat wohl die Chancen des Schweizers reduziert. Die Schweiz geniesst in der Klima-Forschung <Weltruf>; deshalb wurde der Schweizer ETH-Professor Andreas Fischlin als Vize-Praesident in die Arbeits-Gruppe II des IPCC gewaehlt. Die Schweiz wollte eigentlich fuer einen der Stellvertreter-Posten des IPCC-Praesidums kandidieren. Datenschutz-Grundsatz: USA ist kein <Safe Harbor>. ルクセンブルクの欧州司法裁判所(EuGH)は、米国のデータ保護とデータ通信に 判決を下した。EUの裁判所は、米国で2000年から合意された異論の多いデータ 転送いわゆる「セーフ・ハーバー(宥恕規定)」契約は無効との画期的な判断を 示した。これは米国とEU間のデータ交換に関する事柄。EUの裁判所によると、 ヨーロッパ人のインターネットユーザーの米国での個人情報は当局(NSA等)の アクセスから十分保護されていない。EUで事業をしているフェイスブックやグ ーグル他の米国企業は、出生地、電話番号、電子メールアドレス等々の個人情 報を米国で転送しているようだ。EUの判決の意味するところは、「政府と企業 はプライバシーの基本的権利を安易に無視する事は許されない」という事。オ ーストリアのフェイスブック・ユーザーで28歳のマックス・シュレムスはダブ リン(欧州本部)のフェイスブックを提訴した。しかしアイルランドデータ保護 当局は提訴を「セーフ・ハーバー」契約によって棄却した。この程フェイスブ ックの利用者はEUの裁判所から権利を付与されたばかりか、EUの裁判官は「セ ーフ・ハーバー」契約も無効と判断した！新聞は「ゴリアテに対するダビデ」 の勝利と書いた。フェイスブックは世界最大のインターネット企業。「この審 判は、民間企業に強力に支援されて世界中を監視する米国への深刻な打撃にな る、とマックス・シュレムスは言った。この判決は欧州と米国間のTTIP自由貿 易協定の協議も困難にすると記事は書いた。米国人内部告発者エドワード・ス ノーデンもモスクワからツイッターで、「おめでとう、マックス・シュレムス 、君は世界をましなものに変えた」と祝辞を送った。新しい環境はスイスのIT 業界にビジネスチャンスをもたらす。「セーフ・ハーバー」はスイスではデー タの保管とデーター・トラフィックのビジネスモデルと捉えられている。スイ スのサーヴァー・センターは今日既に約40%の外国の顧客に利用されており、 その内およそ50%は米国企業。米国の法人客は現在既に、顧客データを欧州大 陸に保管するよう要求している。(出典：2015年10月6日付ターゲス・アンツァ イガー紙＆2015年10月9日付srf.ch/news) The Court of Justice of European Union in Luxembourg has pronounced a verdict about Data Privacy and the Data Transfer to the USA. The EU- Court declared in a ground-breaking verdict the so-called <Safe Harbor> agreement, a disputed agreement about the data transfer into the USA from the year 2000, as invalid. It is about the exchange of data between the USA and the European Union (EU). Based on the EU- Court, the personal data of European Internet users are insufficiently protected against the access of the authorities (e.g. NSA etc.) in the USA. US-enterprises such as Facebook, Google etc., which are doing business in the EU, had transmitted personal data such as place of birth, phone numbers, E-Mail-address etc. into the USA. The EU-verdict means that <Governments and Enterprises aren't allowed to ignore the fundamental right of privacy>. The 28-years old Max Schrems, a Facebook-user from Austria had made a court action against Facebook in Dublin (European Headquarters). The Irish Data Protection Authority dismissed however the lawsuit by pointing to the <Safe Harbor> agreement. Now, the (little) Facebook-user got right by the EU-Court and the EU-Judges have even declared the <Safe Harbor> agreement as invalid! The newspaper wrote of a victory by <David against Goliath> because Facebook is the worldwide biggest Internet-Group. <That verdict is a serious blow against the worldwide US-surveillance, which is strongly supported by private enterprises>, said Max Schrems. The verdict might also affect the talks about the TTIP-Free Trade Agreement between Europe and the USA, wrote the article. Even the US- Whistleblower Edward Snowden made congratulations on Twitter from Moscow with the words: <Congratulations Max Schrems you have changed the world for the better>. The situation offers business chances for the Swiss IT-sector. The <Safe Harbor> in Switzerland for the Data Storage and the Data Traffic is a business model. The share of foreign customers, which use already today Swiss server hubs is at about 40%, approximately 50% of them are US-companies. Customers of US-enterprises request already today that their customer data are stored on the continent. Der Europaeische Gerichtshof (EuGH) in Luxemburg hat ein Grundsatz- Urteil zum Datenschutz und zur Daten-Uebermittlung in die USA gefaellt. Das EU-Gericht (Court of Justice of European Union) erklaerte in einem bahnbrechenden Urteil das so-genannte <Safe Harbor> Abkommen, eine umstrittene Vereinbarung zur Daten-Uebermittlung in die USA vom Jahr 2000 als ungueltig. Es geht um den Austausch von Daten zwischen den USA und der EU. Laut dem EU-Gericht sind die persoenlichen Daten von europaeischen Internet-Nutzern in den USA ungenuegend geschuetzt vor dem Zugriff der Behoerden (z.B. NSA etc.). US-Unternehmen wie Facebook, Google usw., welche in der EU taetig sind, hatten persoenliche Daten wie Geburtsort, Telefon-Nummern, E-Mail-Adressen usw. in die USA uebermittelt. Das EU-Urteil bedeutet, <dass Regierungen und Unternehmen das massgebende Recht auf Privatsphaere nicht einfach ignorieren duerfen>. Der 28-jaehrige Max Schrems, ein Facebook-Nutzer aus Oesterreich hatte gegen Facebook in Dublin (Europa-Hauptsitz) geklagt. Die irischen Datenschutz-Behoerden wiesen jedoch die Klage mit dem Hinweis auf das <Safe Harbor> Abkommen ab. Jetzt hat der (kleine) Facebook-Nutzer vom EU-Gericht Recht erhalten und die EU-Richter haben sogar noch das <Safe Harbor> Abkommen als ungueltig erklaert! Die Zeitung schreibt von einem Sieg von <David gegen Goliath>, da Facebook der weltweit groesste Internet-Konzern sei. <Dieses Urteil sei ein schwerer Schlag gegen die welt-weite US-Ueberwachung, welche sich stark auf private Unternehmen abstuetze>, sagte Max Schrems. Das Urteil duerfte ebenfalls die Gespraeche ueber das Freihandels-Abkommen TTIP zwischen Europa und den USA belasten, schreibt der Artikel. Sogar der US- Whistleblower Edward Snowden gratulierte aus Moskau per Twitter mit den Worten: <Gratuliere Max Schrems, du hast die Welt zum Besseren veraendert>. Die neue Lage bietet Geschaefts-Moeglichkeiten fuer die Schweizer IT-Branche. Der <Sichere Hafen> (Safe Harbor) in der Schweiz fuer die Daten-Aufbewahrung und den Daten-Verkehr gilt als Geschaefts- Modell. Schweizer Server-Zentren werden schon heute zu zirka 40% von auslaendischen Kunden benuetzt, ungefaehr 50% davon sind US-Firmen. Kunden von US-Unternehmen verlangen bereits jetzt, dass die Kunden- Daten auf dem Kontinent gelagert werden.
