■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ ┃ Multi Lingual Internet Mail Magazine ┃ ★ jp-Swiss-journal - Vol. 135 - April 20, 2012 (Swiss Time) ┃ ☆ http://www.swissjapanwatcher.ch/ ■━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━■ 【 目次 / INDEX / INHALTSVERZEICHNIS 】 【J】 国民投票2012年03月11日の結果 明子 ヒューリマン 「別荘発議」の誤算 【E】 Result of the National Voting Akiko Huerlimann on March 11, 2012 Miscalculation of "The Secondary Residence Initiative" □━━━━━━━━━━━━【 日本語 】━━━━━━━━━━━━━━□ 国民投票2012年03月11日の結果 「別荘発議」の誤算 明子 ヒューリマン 年に数回スイスで行われる国民投票だが、国民投票が決まった議案と同時 並行して、国民投票を目指すキャンペーンについても報じられる。日常的 に何らかの問題意識を抱えながら有権者は暮らしていることになる。年中 国の行く末を案じながら生活するスイス人？確かにそういう一面はある。 スイス人の住まいや地域への関心の寄せ方ひとつ見ていても、人任せには しない。自分の財産は自分で守る意識が強い。冷戦が終結するまで、常に 独立を脅かされてきた国の歴史も影響しているようだ。 投票結果 *1)を見ると、 1. 「別荘」発議は衝撃の賛成50.6%で承認！長年の行政の非効率のツケが 回って来たと評された。 2. 「建設費節減」発議は反対55.8%で敢えなく沈没。諸外国に比べて持家 比率が低いと言われている事情が関係しているようだ。因みに住宅ローン 金利は、ここ数年歴史的な低水準で2.5％程度だ。 3. 「誰にも６週間の休暇」発議は反対66.5%で苦い敗北を喫した。 4. 「マネーゲーム」連邦法は賛成87%で順当に承認された。 5. 「書籍再販売価格維持」連邦法は反対56.1%で予想外の反対多数となっ た。この結果、小規模書店の支援に連邦政府の支援が求められようになる と取り沙汰されている。スイス国民は経済の自由化には保守的な傾向があ るが、今回書籍の価格に国の関与を国民は拒否したと評された。ドイツ語 圏では既に市場競争で5年の経験を積んでいるが、大きな変化は起きてい ないと言われている。諸外国に比べてスイスでは、本の多様性が損なわれ るどころかむしろ拡大しているとも言われている。インターネットで本の 評価を見て購入する傾向が進んでいる今の時代、小規模書店の消滅は今後 避けられない運命とも言われている。 今回の国民投票で最も注目を浴びたのは、「別荘」発議の勝利だった。84 歳のジャーナリストで環境活動家のフランツ・ウェーバー氏は、これまで 12の国民発議をしてきたそうだが、今回初めて国政レヴェルで環境と国土 を守る意思を実らせたと報じられた。50年間の闘いは、50.6％の賛成票と 15のカントンの賛成過半数を得て遂に報われた訳だ。諦めないスイス人の 典型だ。これについて、2012年3月12日付のターゲス・アンツァイガー紙 のファビアン・レンツ記者は次の様に論評した。地域性を無視して自治体 の別荘建設を全国一律20％にするという融通の利かない規制を、国民は受 け入れてしまった。この敗北の責任は、連邦議会、州政府、自治体、経済 団体にあり、妥当な対案が有ったにもかかわらず、充分な周知宣伝活動を しなかった事にある。今後自治体当局は土地利用計画の策定で、自由度を 大きく失う事になった。リゾート地は多くの雇用を喪失する恐れも出てき た。都市部が郡部の土地利用に口出ししたと言われる通り、殆どの大都市 で賛成が過半数を占め、郡部は反対という結果が鮮明に出た。 衝撃を受けた各地の名だたるリゾート地の観光・ホテル業界は政府に救済 措置を求めている。発議者は別荘の賃貸で問題の解決を図ろうとしている。 年間120泊から180泊別荘を貸し出せば、20％の規制を超えないという考え だ。因みにアンダーマットの別荘所有者は、25％しかその気が無いそうだ。 一方、建設業者は上手い抜け道を考え出している。グラウビュンデンのラ ークスで先駆的リゾート計画の取り組みが2009年から始まっている。ロッ クスリゾート *2) の <buy to use and let> 方式で、ここのアパートの 購入者は12月から3月までのハイシーズンに最高3週間利用出来る制度だ。 家族連れにはホテルよりも貸しアパートが人気なので、この種のリゾート を大手のインターホーム *3) が地方自治体と協力して今後も建設を進め るようだ。結局のところ、「別荘発議」の目指す「緑地の減少を止める」 方向に必ずしも向かわないようなのだ。 巧妙な手口として、別荘を建てる自治体に、妻を住民登録させるか、家政 婦に賃貸すると届け出る等の方法が広まると予想されている。更に多くの リゾート地の自治体が既に別荘の建設を許可しており、最も先はツオツの 2021年までと、今後も続々と別荘は建設されるようだ。スイスの南半分の 殆どの地域は別荘が20％を超えている。これ等の地域では今後自治体の合 併が進むと見られている。世界的な観光地ベルナー・オーバーラントゥが 在るカントン・ベルンも、4月になって各自治体に年末までに別荘建設の許 可をするよう駆け込み需要を推奨した。次から次へと別荘建設の動きが加 速しているかの如き様相を呈してきて、別荘発議は見事裏目に出た感が否 めない。 ブリークのホテル経営者で元社会民主党（SP）党首のペーター・ボーデマ ン氏は、「別荘発議はスイス観光に新しい発明をもたらすことになる」と 語っている。「別荘発議」の規制を逃れる工夫は考え次第で幾らでも出て 来るようで、混乱を招くだけと考える人々は少なくないようだ。なんでも かでも全国的な国民投票を可能にする制度に、いよいよ行き詰りが見えて きた代表例がこの別荘発議ではないかという印象だ。この議案は憲法条項 にも修正が必要になって来る要素があると言われている。実際、スイスの 憲法は頻繁に修正されるので、連邦法との違いが素人には分からない。 SPは外国人の不動産購入を将来最低5年居住しなければ出来ないよう厳しく 制限しようと動き出し、ターゲス・アンツァイガー紙のオンライン投票で は78%がこれを支持している。この動きは一見、別荘建設阻止に貢献しそう だが、チューリッヒの高級住宅地で豪華アパートが売れ残っているという 報道があった。特定の地域で不動産市場の過熱傾向が伝えられてきたが、 スイスでも経済の先行きに不透明感が言及されるようになり、「別荘発議 」が無くても自然に調整される形勢ではあるのかもしれない。一方保守政 党は外国人の不動産購入を緩和しようとしていると報じられた。企業経営 者が多い保守層の目論見は、今後も外国資本を受け入れようとしているら しい。基本的に、外資が投資意欲を示す土地や企業は魅力的な証だ。いず れにしても、直接民主制 *4) は良いとして、国民投票を法制化し得る実 効ある制度に改正する必要があると思う。 【 参照 】 *1) 2012年3月11日国民投票の結果： http://www.tagesanzeiger.ch/ schweiz/standard/So-hat-das-Stimmvolk-entschieden/story/27349528 *2) ロックスリゾート: http://www.designhotels.com/hotels/europe/switzerland/laax *3) インターホーム: http://www.interhome.com/english/for+home+owners *4) 直接民主主義: http://en.wikipedia.org/wiki/Direct_democracy 【 編集後記 】 2012年6月17日に次の国民投票が既に予定されている。関連報道も徐々に始 まっていることに気付いた。見逃している事があるのではないかと少々慌て ている。 【注意】Mag2で購読の登録注意：<Bluewin>のメールアドレスを使用してい る場合、Mag2から配信されるメルマガがスパムメール扱いで停止されている 事が、<Bluewin> に問い合わせて確認出来ました。1000通以上スパムメール 扱いになっているメールアドレスは、ウェブメールにも送られないよう設定 されるという説明でした。<gmail>, <Yahoo!メール>のアドレスは配信が確 認されています。 □━━━━━━━━━━━━━【 English 】━━━━━━━━━━━━━□ Result of the National Voting on March 11, 2012 Miscalculation of "The Secondary Residence Initiative" Akiko Huerlimann National voting is taken place a few times per year in Switzerland; therefore it is reported about national voting, which is under campaigning and at the same time, media report simultaneous about initiatives that are on the process of being launched. That means Swiss constituency creating their life everyday with some awareness of political matters. Are they living always with worries about the future? Certainly there are such aspects. Observing Swiss people, they do hands-on the matters of their housing or community. Their will is strong to protect their own fortune on their own. That could be influenced by their history as their independency was always threatened until the end of the cold war. Let's have a look at the result. *1) 1. Initiative "Secondary Residence" was a devastating result; it was accepted with 50.6% of "Yes"! It's said that years of inefficient administration works caused this result. 2. Initiative "Building-Savings" was hopelessly rejected with 55.8% of "No". It seems related to the lower house owner ratio in Switzerland compared to other countries. Just for your information, the housing loan interest is at a historically low level with 2.5% for years. 3. Initiative "6 Weeks Holiday for Everybody" suffered a defeat with 66.5% of "No". 4. Federal Law "Money Games" was accepted with 87% of "Yes". 5. Federal Law "Resale-Price Maintenance for Books" was unexpectedly rejected with 56.1% of "No". It's said that small book shops shall claim support from the State with this result. Swiss people tend to be conservative for a liberalization of economy; however, people rejected the involvement of the State for the book price. The German part has the experience in the market already for five years, but it is said that the big change hasn't happened. It's said that compared to other nations, in Switzerland that has not spoilt the diversification of books and that's even becomes wider. Nowadays, people tend to buy books by reading book review on the internet; the destiny that small book shops might disappear cannot be avoided. The most noticed bill was the success of the initiative of "Secondary Residence". Mr. Franz Weber, an 84 years old journalist and environment activist, has organized 12 bills for national voting so far, and this time it was his first success for protecting environment and land on a nationwide level. Fifty years of his fighting was finally rewarded with 50.6% of citizen votes and a majority of fifteen cantons. He is one of the typical Swiss who has never given up. Mr. Fabian Renz of Tages-Anzeiger wrote a comment about it on March 12,2012. The Swiss nation has just accepted such an inflexible restriction that ignores regional characteristics and second house constructions maximized up to 20%. The responsibility of this fail should be owned by the Federal Parliament, Cantonal Parliaments, local Governments, and economic organizations those who didn't act enough in the campaign although there was a reasonable counter proposal. Local Government will lose a big freedom of land plan in the future. Resort places are said to loose many employments. The result was obvious as said, land usage in rural area was interfered by cities; majority voted "Yes" in almost all big cities, whereas majority voted "No" in rural areas. Tourism and hotel industry in many famous resorts were shocked and claimed for help to the Government. The initiative tries to solve the problem with the let of the holiday houses. They think if the holiday houses are lent between 120 to 180 nights, the restriction of 20% will not be exceeded. For instance, only 25% of the holiday house owners in Andermatt have that intention. On the other hand, construction companies invented a clever loophole. A pilot resort project was started in Laax (Graubuenden) since 2009. "Buy to use and let" system of Rocksresort is that a person who bought the flat can use it three weeks in high season from December till March. A holiday apartment is more popular than a hotel to a family, therefore, one of the major companies <Interhome> *3) is also going to make further developments of this kind of resorts together with local governments. It turned out, the reality is not forwarding to the aim of "Secondary Residence initiative" that tries to stop decreasing green land. It is expected that shrewd tricks methods will be spread such as to register the wife as resident where one wishes to build a holiday house or lent the house to the housemaid. More over resort municipalities have already granted permissions for building holiday houses, and the furthest case is till 2021 in Zuoz; holiday houses will spring up like mushrooms in the future as well. Almost all regions in a half of southern Switzerland, holiday houses exceeded 20%. Annexation in those areas is expected to be promoted. Canton Bern recommended rush demand to municipalities for granting permissions to construction of holiday houses in April where world famous tourist region of Berne overland is located. Holiday house constructions seems to be accelerated one after another, and we have to admit that the "Secondary Residence Initiative" worked negatively. Mr. Peter Bodemann, hotel manager in Brig and former SP (Social Democratic Party) president said, "the Secondary Residence Initiative will bring new invention to Swiss tourism." There are plenty of ways to escape from restriction of the Secondary Residence Initiative, and many people think that the bill would create just confusion. I got an impression that the system anything possible to make national voting finally runs into an impasse that represent the bill of Secondary Residence Initiative. It's said this bill has an element needing a certain amendment of the constitution. Actually Swiss constitution is often adjusted, and the difference with the Federal law is not clear for normal people. The SP-party is intending to introduce a strengthening of the restriction of real-estate acquisition by foreigners that should be lived at least five years in the future; the online vote of Tages- Anzeiger showed that 78% of people supported that. That movement looks stopping holiday house constructions, however, there is a report that luxury apartments in exclusive residential quarters in Zurich are remained unsold. An Over-heated real-estate market in certain area has been reported, but uncertainty of the future economy is mentioned in Switzerland too, therefore, the circumstances could be automatically adjusted without the "Secondary Residence Initiative". But reportedly conservative parties wish to deregulate purchase of real estates by foreigners. The plan scheme of conservative class that belong many business entrepreneurs is going to accept foreign capital. Basically, when ground or companies are attractive then foreign capital shows intention for investment.
